Richard Stevens called the meeting to order at 9:20 a.m.

Dan Creedon (Attorney), Scott Jones (Project Engineer), and Robert Kelliher (contractor) appeared. Attorney Creedon addressed the meeting saying that by way of history this proposed project has been in various stages of planning and permitting since 2005/2006. He said it has been through 2 owners. Went to zoning in 2007 for set-back relief variance. Had been on agenda for Planning back in 2007 but it had been determined that the development agreement had expired. Matter then brought to the Cape Cod Commission for Jurisdiction Determination and a Hardship Exemption. Jurisdiction Determination was withdrawn; and later in 2008 Cape Cod Commission granted a Hardship Exemption.
Mr. Creedon said that in 2010 his client, the Applicant, acquired the property from the prior owner and was granted a second variance in June-2010.
Mr. Creedon said that originally a 20,870 square foot building was proposed and that was the maximum permitted under the development agreement. The current proposal is 20,000 square feet. Glen Harrington asked whether the January-2008 plan depicted 20,000 square feet. Mr. Creedon responded “yes”.
Mr. Creedon said they are looking at use categories M, B, F-1, S-1 and S-2. The building will be sprinkled.
Charlie Maintanis asked whether or not they are planning some retail. Mr. Creedon responded that they are not asking for any use at this time; the owner wants to investigate what use interest there is for the building. Tom O’Hara said this is a great opportunity since the Town did approve use other than commercial in that area. Tom Fudala said you have to specify and apply for some use so you make sure parking works. Tom O’Hara added that this is a one-story building and square footage determines parking also. Charlie Maintanis noted the handicap parking is enough now, but it depends on use group to determine what is finally required. Charlie pointed out that applicant should keep in mind they can’t have both hazardous use and mercantile group; some uses not allowed in

industrial zone; and fire separation can be a problem. Charlie said if use group requires public restrooms then you have certain requirements to meet re handicap accessibility so you may want to plan that in doing bathrooms right at the beginning.
Joel Clifford said Fire Department access issues still have not been resolved. Project Engineer Scott Jones said Chief Baker sent him an e-mail and Mr. Jones said he is going back to his engineer to address the issues. Joel reminded him that once done then the plans have to be submitted to the Fire Department for review. Mr. Jones said that their engineer on the project, Peter Sullivan, will be at tomorrow’s Planning meeting.
Joel Clifford noted that with driveway access on Commercial Street the Fire Department cannot make a radius turn into the parking lot which would leave the side of the building on Industrial Drive facing the side back with no Fire Department access so Joel said what was discussed is to just move the driveway down to the far extreme left and have the Fire Department connection for the sprinkler system on that side of the building also.
Joel Clifford suggested they think about designating a fire lane so fire truck apparatus will have adequate parking at far North End of the building. 18 foot space needed for declared fire lane.
Glen Harrington pointed out that shallow root system type of shrub should be planted over leaching trenches, rather than deep rooted trees shown on landscape plan.
Glen advised that the Plan has to go back to the Board of Health because the original permit expired so they have to go back though Board of Health.
Catherine Laurent said that not specific to this property but to the entire industrial property is the big issue with drainage on the road. Catherine said at Police Department’s request they have had to close the road multiple times because it is impassable. Catherine said it is not a public road but is a private road and is the responsibility of owners on the street to take care of it. Catherine advised that she will send a letter to the Planning Board voicing this concern. Tom O’Hara commented that this problem is the result of using the area as a sandpit when they excavate all the local properties they use the storage yard as a sand pit.
It was suggested that the catch basins should be cleaned. While it may need more done than that, the catch basins should be looked at.
Tom O’Hara suggested that at the West elevation of the building they incorporate some windows into the wall and/or have some business fronted right there to have some easy access and break up the vast look of the building.
Tom Fudala asked if they were going to put a street sign up at the corner of Commercial Street and Industrial Drive section? Catherine Laurent pointed out the street sign should meet Federal Highway requirements for signs. Catherine will pass along to applicant the company name the Town uses for street signs.
Tom O’Hara advised that when they come to address signage they should specify how many square feet of each area signage is needed. They should designate area for each business. Mr. Jones said they were thinking about duplicating a ladder sign used on another property in Industrial Park.

Tom Fudala suggested Applicant should come back to this group with changes before going to the final meeting with the Planning Board. Tom Fudala said Applicant could make their presentation to the Planning Board tomorrow night and get feedback.
CONCLUSION: Continued until next Design Review/Plan Review meeting. Applicant will check with Pat White to get on May 3rd agenda.
Catherine Laurent exited the meeting at 9:55 a.m.

Cape Cod regional Transit Authority
Installation of two bus shelters
South Cape Village and Mashpee Community Health Center
Representative – Matthew Kolva______________________
Matthew Kolva appeared. He said there are 2 locations where they want to install bus shelters—showed photo of spot in South Cape Village and spot on Commercial Street in front of Health Center. Mr. Kolva said he spoke to the owners and they signed off since Transit Authority maintain the shelters. He said they are just following up on what they were suppose to do since a while back Cape Cod Commission instructed the shelters be installed. He said the route of the bus is being changed. The shelters will have plexiglass—no glass. He said shelter is movable structure with anchoring.
Bob Nelson said a portable shed has to be 5 feet from the street. Tom Fudala said the Selectmen may have to sign off on it. Tom Fudala said it is a site plan change so it has to go to the Planning Board.
Joel Clifford asked whether they obtained street addresses for the 2 shelters. Joel pointed out that since there are 2 how is each one identified in an emergency. Mr. Kolva said he would check with the Town Clerk about getting street address assigned.
Tom O’Hara questioned safety issue. Mr. Kolva said they could put bollards up—not a big issue. Mr. Kolva said in most places he put bike racks in also but bike rack already there at South Cape Village.
CONCLUSIONS:
South Cape Village Bus Shelter:
Motion: Tom Fudala motioned Plan Review to recommend installing the bus shelter at the South Cape Village location as shown on the Plans but that the Plans be improved to show exactly where it is; Glen Harrington seconded the motion.
Discussion: What about caveat for Street address.
AMENDED MOTION: Tom Fudala motioned Plan Review to recommend installing the bus shelter at the South Cape Village location as shown on the Plans but that the Plans be improved to show exactly where it is and that Applicant obtain a street address for the bus shelter from the Town Clerk; Charlie Maintanis seconded the motion.
Vote: Passed unanimously.
Cape Cod regional Transit Authority (continued)
Motion: Tom O’Hara motioned Design Review to recommend installing the bus shelter at the South Cape Village location as shown on the Plans but that the Plans be improved to show exactly where it is and that Applicant obtain a street address for the bus shelter from the Town Clerk; David Kooharian seconded the motion.
Vote: Tom O’Hara and David Kooharian voted yes; Bob Nelson abstained. The motion passed.
Health Center Bus Shelter:
Tom Fudala suggested Applicant talk to DPW re drainage and road easement. Mr. Kolva said he will talk with Catherine Laurent. Tom Fudala also suggested Mr. Kolva contact Holmes and McGrath for a copy of the latest site Plan.
Motion: Tom Fudala motioned that Plan Review to conceptually approve the Health Center Bus Shelter provided applicant secures whose property it’s on; Charlie Maintanis seconded the motion;
Vote: Passed unanimously.

Approval of Minutes
Plan Review…Charlie Maintanis motioned to accept the minutes of the Combined Meeting of Design Review and Plan Review meeting of February 15, 2011 with changes as discussed; Tom Fudala seconded this motion. The motion was approved by Plan Review, with Scott Carline abstaining.
Design Review…Tom O’Hara motioned to accept the February 15, 2011 minutes of the Combined Meeting of Design Review and Plan Review meeting as amended; Bob Nelson seconded the motion. The motion was approved by Design Review, with David Kooharian abstaining.
